What would you do if you were the restaurant manager?

Tamir was a truck driver for a produce company. While he was making a delivery to
a restaurant, the cook invited him to try some chicken salad prepared earlier following a new recipe.


The salad had been in a bowl at room temperature for several hours.
Approximately four hours after eating it, Tamir became afflicted with a foodborne illness.


He filed suit against the restaurant, whose attorney maintained that because
Tamir was not a paying customer and had been invited to sample the salad without
cost, the restaurant had no liability.

First, the argument that the restaurant could not be liable because Tamir was not a paying customer is without merit.
Second, the anager needs to retrain the entire
kitchen staff on appropriate sanitation and food safety procedures.
